Nonresident Athlete Individual Income Tax

How to File Federal Taxes in 2022

A nonresident individual who is a member of the following associations is considered a professional athlete and is required to electronically file a Louisiana income tax return, IT-540B reporting all income earned from Louisiana sources:

  • Professional Golfers Association of America or the PGA Tour, Inc.
  • National Football League
  • East Coast Hockey League
  • Pacific Coast League

Income from Louisiana sources include compensation for the services rendered as a professional athlete and all income from other Louisiana sources, such as endorsements, royalties, and promotional advertising. The calculation of income from compensation is based on a ratio obtained from the number of Louisiana Duty Days over the total number of Duty Days. Duty Days is defined as the number of days that the individual participated as an athlete from the official preseason training through the last game in which the individual competes or is scheduled to compete.

S Corporation And Partnership Tax Returns Due

Note that S corporations and Partnerships do not pay taxes on their income. That tax is paid on the individual incomes of the shareholders or partners, respectively.

File For An Extension By Tax Day

Income Tax Calendar 2021

If you can’t finish your return by the April 18 tax deadline, file IRS Form 4868. This will buy most taxpayers until Oct. 17 to file their tax returns. See more about how extensions work.

Note: A tax extension gets you more time to file your return, not more time to pay your taxes. You still must pay any tax you owe, or a good estimate of that amount, by the tax deadline. Include that payment with your extension request or you could face a late-payment penalty on the taxes due.

For fiscal year filers:

  • Partnership and S Corporation tax returns will be due the 15th day of the third month after the end of their fiscal tax year.
  • C Corporation tax returns will be due the 15th day of the fourth month after the end of their fiscal tax year. A special rule to defer the due date change for C Corporations with fiscal years that end on June 30th defers this change until December 31, 2025.
  • Employee Benefit Plan tax returns are due the last day of the seventh month after the plan year ends.

It is important to confirm when tax returns are due for all states in which taxpayers operate, because individual states may not conform to the Federal filing dates.

Once you enter all your information, it will tell you what is going on with your refund. Remember, if you input the wrong SSN, it could cause an IRS Error Code 9001, and might make your return be held for Identity Verification.

Are There Any Expected Tax Refund Delays

Yes, tax refund delays are common. The IRS is required by federal law to withhold tax refunds for taxpayers who claim Earned Income Tax Credits and Additional Child Tax Credit until at least Feb. 15, 2022. Keep in mind it can still take a week to receive your refund after the IRS releases it. So some people who file early may experience delays while awaiting their refunds. Refunds should be processed normally after this date.

Note: There may be delays for the 2021 tax year. The IRS continues to work through a backlog of tax returns , including those with errors and amended returns.

The IRS recommends filing your tax return electronically for faster processing and tax refund payments.

Also note that new identity theft protections and anti-fraud measures may hold up some refunds, as some federal tax returns may be held for further review.

Resident Individual Income Tax

Resident taxpayers who are required to file a federal individual income tax return are required to file a Louisiana income tax return,IT-540, reporting all of their income. If a Louisiana resident earns income in another state, that income is also taxable by Louisiana. A temporary absence from Louisiana does not automatically change your domicile for individual income tax purposes. As a resident taxpayer, you are allowed a credit on Schedule G for the net tax liability paid to another state if that income is included on the Louisiana return.

Residents may be allowed a deduction from taxable income of certain income items considered exempt by Louisiana law. For example, Louisiana residents who are members of the armed services and who were stationed outside the state on active duty for 120 or more consecutive days are entitled to a deduction of up to $30,000. In each case, the amount of income subject to a deduction must be included on the Louisiana resident return before the deduction can be allowed.
