Experts give tips for filing 2022 taxes as IRS faces backlog amid COVID-19 pandemic

The Internal Revenue Service advises that U.S. citizens and resident aliens living outside the United States can use IRS Free File to prepare and file their federal tax returns electronically.

What Type Of Documentation Is Required

If an employer has claimed the ERC, they must have sufficient documentation to substantiate eligibility under either the gross receipts decline or government order tests, including how the orders negatively impacted their operations in a more than a nominal way. See Notice 2021-20, Q& A 70. In ERC audits, the IRS has been known to request documentation for the quarters the ERC is claimed, such as: the work papers used to compute the ERC, payroll journals, the employees names, the amount of wages paid to each employee for which the ERC is claimed, evidence that the taxpayer experienced a significant decline in gross receipts, and application of any PPP loan forgiveness.

The IRS has also been known to request bank records, such as statements and canceled checks, and general books and records, such as the general ledger, accounts payable, and the trial balance. According to the IRS, documentation related to the ERC claim, including all records of employment tax, of an eligible employer should be retained for at least four years after the date the tax becomes due or is paid, whichever comes later. The IRS subsequently extended the statute suggesting documentation should be maintained for at least five years.

Why Was The Free File Alliance Formed

In November of 2001, the Office of Management and Budget’s Quicksilver Task Force established 24 e-government initiatives that were a part of the President’s Management Agenda. These initiatives were designed to improve government to government, government to business and government to citizen electronic capabilities.

One initiative, IRS Free File, instructed the IRS to provide free and secure online tax return preparation and filing services to taxpayers. In accordance with this OMB directive, the IRS worked in partnership with the tax software industry to develop a solution. The result was the formation of the Free File Alliance, LLC.

Checking Employee Retention Credit Claims Before The Irs Does

Now is the time for employers to reexamine their Employee Retention Credit claims and to proceed prudently in filing any new ones. If a claim is too good to be true, it might be what the IRS is warning about, say Kristin Balding Gutting, Troy Taylor, and Joshua Elliott of FORVIS.

It has become clearer that the Employee Retention Credit is a priority enforcement topic for the IRS. Like other priority enforcement topics, such as micro-captives and conservation easements, the IRS issued a stern warning to employers in October to be wary of third parties who are advising them to claim the ERC when they may not qualify. Thus, it is more important than ever for employers to revisit their ERC positions.

Who Qualifies As A Retiree Vs A Senior

Although âretireeâ and âseniorâ are often used interchangeably, the tax code has specific definitions used for evaluating your eligibility for tax breaks:

  • Retirees: The term âretireeâ has no legal meaning in the tax code unless it gets accompanied by a disability. In this case, it means youâre retired and unable to work due to a disability.
  • Seniors: Individuals who turn 65 during the tax year are considered seniors. If youâre part of this category, you qualify for any tax breaks reserved exclusively for seniors.
  • If youâre under age 65 and you arenât disabled, you wonât qualify for the tax deductions available to seniors. This may often be the case as you can retire at any age.

Irs Reminds Taxpayers Irs Free File Remains Open Until Nov 17

  • IRS Statements and Announcements
  • IR-2022-199, November 15, 2022

WASHINGTON The Internal Revenue Service today reminded those who still need to file their 2021 tax returns that IRS Free File remains open until November 17 and can help those who qualify claim the Child Tax Credit, Recovery Rebate Credit or Earned Income Tax Credit.

These and other tax benefits were expanded under last year’s American Rescue Plan Act and other recent legislation. The only way to get these valuable benefits, however, is to file a 2021 tax return.

Last month, the Internal Revenue Service sent letters to more than 9 million individuals and families who appeared to qualify for a variety of key tax benefits but had not yet claimed them by filing a 2021 federal income tax return.

Many in this group may be eligible to claim some or all of the 2021 Recovery Rebate Credit, the Child Tax Credit, the Earned Income Tax Credit and other tax credits, depending on their personal and family situation. The letter, printed in both English and Spanish, provided a brief overview of each of these credits.

Often, individuals and families can get these expanded tax benefits, even if they have little or no income from a job, business or other source. This means that many people who don’t normally need to file a tax return should do so this year, even if they haven’t been required to file in recent years.
