Tax-free weekend in Missouri: what you need to know

The United States is the land of the free. Different people value aspects of freedom differently and therefore may have different definitions of what freedom means. Under the United States Constitution, each state has control over many of the laws and regulations within its own borders. Because of this, laws can vary widely between states. People

Freedom in the 50 States is a report that ranks each state based on a combination of personal and economic freedoms. The report defines individual freedom as the ability to dispose of ones own life, liberty, and justly acquired property however one sees fit, so long as one does not coercively infringe on another individuals ability to do the same. These include fiscal policy, regulatory policy, and personal freedom.

Fiscal policy includes state taxation, local taxation, government consumption and investment, government debt, and cash and security assets. Regulatory policy includes: land-use freedomn, labor market freedom, lawsuit freedom, occupational freedom, miscellanrous regulatory freedom, and cable and communications. Personal freedom includes incarceration and arrests, guns, gambling, marriage, education, alcohol, asset forfeiture, marijuana, tobacco, mala prohibita and civil liberties, travel freedom, and campaign finance.

Designate Product Tax Rates With Smart Categorization

Is a hotdog a sandwich? As a society, we may never be able to agree on the answer, but at Shopify, we can help you categorize your hotdog for tax purposes. If you live in New York, you may find that you pay tax when you buy a hotdog from your local stand, but not when you buy a pack for your neighborhood barbecue. In each state, different rules govern the amount of tax that should be assessed on your product.

Thats where smart categorization comes in. Smart categorization works on your behalf to decode these rules whenever you add a new product to your Shopify store. Based on the description you enter, Shopify recommends a product category for you. Once you approve or modify the recommended category, Shopify automatically assigns the proper tax rate based on local regulations so that your customer pays the right amount at checkout.

Rules To Follow When Evaluating Sales Tax On Services

1. Avoid making assumptions

Many companies assume services delivered in conjunction with goods sold arent taxable, but that’s often not the case. Delaware, Hawaii, New Mexico, and South Dakota tax most services. Still others, like Texas and Minnesota, are actively expanding service taxability.

Businesses that sell services across multiple states need to know where those services are subject to sales tax. The fact that sales tax laws often change makes it challenging to remain in compliance.

2. Remember that sales tax rates can change

States regularly change product and service taxability rules, and the onus of staying on top of changes is on businesses. For example, Washington state lawmakers decided to tax martial arts and mixed martial arts classes in the fall of 2015. Two years later, many of those services were once more exempt. Failure to correctly apply sales tax rates and rules to products and services can lead to costly errors.

Knowing which rate to charge and which sales tax rules apply is especially challenging for companies that sell goods or services in multiple states. No two states have the same sales tax laws.

3. Understand your nexus exposure

Determining nexus is the first step toward sales tax compliance.

4. Services sold with taxable goods can complicate sales tax
5. The true object test can help determine service taxability

How An Excise Tax Works

Excise taxes are primarily for businesses. Consumers may or may not see the cost of excise taxes directly. Many excise taxes are paid by merchants who then pass the tax on to consumers through higher prices. Merchants pay excise taxes to wholesalers and consider excise taxes in product pricing which increases the retail price overall. There are some excise taxes however that are paid directly by a consumer including property taxes and excise taxes on certain retirement account activities.

Federal, state, and local governments have the authority to institute excise taxes. While income tax is the primary revenue generator for federal and state governments, excise tax revenue also makes up a small portion of total revenue.

Excise taxes are primarily a business tax, separate from other taxes a business must pay, like income taxes. Businesses charging and receiving excise taxes are required to file Form 720 Federal Excise Tax Return on a quarterly basis and include quarterly payments. Business collectors of excise taxes must also maintain their obligations for passing on excise taxes to state and local governments as required. Merchants may be allowed deductions or credits on their annual income tax returns related to excise tax payments.

Paying Taxes Is A Part Of Life For Most Americans And While Everyone Is Subject To The Same Irs Tax Laws When They File Their Federal Tax Return Annually They Dont Necessarily Pay The Same State Income Taxes

Free State Income Tax E

Why? Where you live and work affects the state tax laws that apply to you. Some states dont have any income tax at all and you may be tempted to relocate to one thinking the move will reduce your overall tax obligation.

While the thought of living in a state where income taxes arent taken from your paycheck may be appealing to those who live in states where their income is taxed, theres usually a give and take. States may need to make up for a lack of income tax revenue in other ways. For example, some states have higher sales tax rates or rely on money from tourism to help fund budgets. Others have local taxes levied by municipalities or counties.

Before you consider a move to a state with no personal income tax, its important to know all the details and how they could impact you.

Keep in mind, just because you live in a state that doesnt have an income tax doesnt necessarily mean you wont file a state income tax return. If you live in one state and work in another, you may have to file an income tax return in the state where you earn your paycheck. Likewise, if you moved during the tax year and previously worked in a different state, youll likely need to file with that state. Its important to check each states tax laws to find out the details.

Categories Of Taxable Services

No two states tax exactly the same specific services, but the general types of services being taxed can be divided roughly into six categories.

Services to TPP: Many states have started to tax services to tangible personal property at the same rate as sales of TPP. These services typically improve or repair property. Services to TPP could include anything from carpentry services to car repair.

Services to real property: Improvements to buildings and land fall into this category. One of the most commonly taxed services in this area is landscaping and lawn service. Janitorial services also fall into this category.

Business services: Services performed for companies and businesses fall into this category. Examples include telephone answering services, credit reporting agencies and credit bureaus, and extermination services.

Personal services: Personal services include a range of businesses that provide personal grooming or other types of self-improvement. For example, tanning salons, massages not performed by a licensed massage therapist, and animal grooming services can be considered personal services.

Professional services: The least taxed service area, in large part because professional groups have powerful lobbying presences. Professional services include attorneys, physicians, accountants, and other licensed professionals.

Paychecks And Retirement Benefits Are Safe From State Taxes If You Live Here

by John Waggoner, AARP, Updated March 9, 2022

En español | Saving for retirement is important, but saving money in retirement is important, too. One possible way to save money is to move to a state with no income tax. For retirees, that can mean no state tax on Social Security benefits, pensions and other sources of retirement income.

Nine states Alaska, Florida, Nevada, New Hampshire, South Dakota, Tennessee, Texas, Washington and Wyoming have no income taxes. New Hampshire, however, taxes interest and dividends, according to the Tax Foundation. It has passed legislation to begin phasing out that tax starting in 2024 and ending in 2027.

Total Tax Burden: 819%

The Lone Star State loathes personal income taxes so much that it decided to forbid them in the states constitution. Still, because infrastructure and services must be paid for somehow, Texas relies on income from sales and excise taxes to foot the bill.

Sales tax can be as high as 8.25% in some jurisdictions. Property taxes are also higher than in most states, the net result of which is a total tax burden of 8.19% of personal income. Nevertheless, Texans overall tax bite is still one of the lowest in the U.S., with the state ranking 19th. Texas is average for affordability at 22nd in the nation, but it was ranked 31st by U.S. News & World Report on the Best States to Live In list.

Texas spent $9,827 per pupil on education in 2019, ranking it below average among the 17 Southern states, and it received a D grade for its school funding distribution in 2015. In 2021 the ASCE awarded it a grade of C for its infrastructure. Texas spent $6,998 per capita on healthcare in 2014, the seventh-lowest amount in the U.S.

One advantage of living in a no-tax state is that the $10,000 cap on state and local tax deductions imposed by the Tax Cuts and Jobs Act will likely not have as great an impact as it does on residents of high-tax states, such as California and New York.

State And Local Real Estate Taxes

Deductible real estate taxes are generally any state or local taxes on real property levied for the general public welfare. The charge must be uniform against all real property in the jurisdiction at a like rate.

There are popular loan programs that finance energy saving improvements through government-approved programs. You sign up for a home energy system loan and use the proceeds to make energy improvements to your home. In some programs, the loan is secured by a lien on your home and appears as a special assessment or special tax on your real estate property tax bill over the period of the loan. The payments on these loans may appear to be deductible real estate taxes however, they’re not deductible real estate taxes. Assessments or taxes associated with a specific improvement benefitting one home aren’t deductible. However, the interest portion of your payment may be deductible as home mortgage interest. Refer to Publication 936, Home Mortgage Interest Deduction and Can I Deduct My Mortgage-Related Expenses? to see whether you might qualify for a home mortgage interest expense deduction.

If a portion of your monthly mortgage payment goes into an escrow account, and periodically the lender pays your real estate taxes out of the account to the local government, don’t deduct the amount paid into the escrow account. Only deduct the amount actually paid out of the escrow account during the year to the taxing authority.

Total Tax Burden: 574%

Before 2016, Tennessee taxed income from investments, including most interest and dividends but not wages. Legislation passed in 2016 included a plan to lower taxes on unearned income by 1% per year until the tax was eliminated at the start of 2021. To make up for the shortfall, Tennessee levies high sales taxes and the highest beer tax of any state in the union at $1.29 per gallon.

With full implementation of the new legislation, Tennessee expects to attract retirees who depend heavily on investment income. The states total tax burden is 5.74%, the second-lowest in the nation. In the affordability category, Tennessee ranks 17th overall, and on the U.S. News& World Report Best States to Live In list, it ranks 29th.

In 2019, at $9,868 per pupil, Tennessee ranked just above Texas in terms of education spending in the southern U.S. It also did a better job of fairly distributing its school funding than the Lone Star State did, earning the Equality State a C in 2015.

At $7,372 per capita, Tennessee ranked 39th in terms of healthcare spending in 2014. The state hasnt received an official letter grade for its infrastructure yet, although the ASCE did note that 4.4% of its bridges are structurally deficient and 276 of its dams have a high hazard potential.
