Tax credits are legislative enactments that allow a taxpayer to reduce the amount of tax they owe. After a taxpayers tax liability is calculated, a taxpayer may then directly reduce their liability by tax credit amounts they are eligible for.

Take a taxpayer who has one child and is eligible for the Child Tax Credit. The taxpayers taxable income is $50,000, and the taxpayers tax liability is $4,500. The Child Tax Credit directly, dollar for dollar, reduces the tax liability from $4,500 to $2,500. The Child Tax Credit is not applied to the $50,000 of taxable income instead, it is directly applied to the tax liability amount.

The largest tax credits are all associated with legislative incentive endeavors for specific types of taxpayers. What Is The Corporate Alternative Minimum Tax

The U.S. Congress enacted the corporate alternative minimum tax as part of the Inflation Reduction Act of 2022. It applies for tax years beginning after Dec. 31, 2022.

Generally, corporations with average annual adjusted financial statement income exceeding $1 billion for three consecutive tax years are taxed at a flat 15% rate in the third year, if the CAMT liability exceeds a corporations regular corporate tax liability.

Corporations subject to the CAMT must calculate their taxes under both the regular corporate tax rules and under the CAMT, and will be liable for the higher of the two amounts. The law does not apply to S corporations, real estate investment trusts, regulated investment companies, and private equity funds.

Who Qualifies For The New Monthly Child Tax Credit Payments

You will qualify for the child tax credit expansion if your modified adjusted gross income is up to $75,000 for single filers, or up to $150,000 for married couples. You may still qualify for a partial child tax credit of $2,000 if your MAGI is less than $200,000 per year . If you exceed these amounts, the credit phases out, or you wont qualify for anything.

To qualify, your child must also meet a the following qualifications:

  • They must have a valid Social Security number.
  • They must live with you for at least half the year, and be related to you.
  • You must provide more than half of your childs financial support, which includes lodging, food, utilities, repairs, clothing, education and other costs.

Article I, Section 9 of the U.S. Constitution states: “No Capitation, or other direct, Tax shall be laid, unless in Proportion to the Census or enumeration herein before directed to be taken.” In 1894, Congress passed the Wilson-Gorman Tariff, which created an income tax of 2% on income of over $4,000. Charles Pollock contested that the tax was unconstitutional under Article 1, Section 9. As such, the Supreme Court granted certiorari to hear this issue in Pollock v. Farmers Loan and Trust Company, 157 US 429 .

In Pollock, the Court held that the Wilson-Gorman Tariff was unconstitutional under Article I, Section 9 of the Constitution, as the act created a direct taxation on property owners, not a tax apportioned among the states.

    There is international support for a global corporate minimum tax to reduce tax competition among nations. In 2021, more than130 countries agreed to a global corporate minimum tax proposal developed by the Organisation for Economic Co-operation and Development . The U.S. is a member of the OECD and the most important signatory to the tax proposal. Implementation is scheduled for 2023.

    The OECD minimum tax is a flat 15% tax on the profits of multinational corporations whose ultimate parent entity has average revenues of 750 million euros , or approximately $814 million, or more in two of four years. The OECD plan is intended to discourage profit shifting and tax base erosion. To be effective, the flat rate tax must apply to a consistent and commonly defined income base.

    Although the U.S. has signed the OECD agreement and employs the same flat tax rate, the structure of the U.S. CAMT does not conform to the basic OECD requirements. For example, the OECD plan applies to many more corporations than does the U.S. law. Because U.S. participation is necessary for the global minimum tax to achieve its goals, either amendments to the U.S. law or adjustments of the OECD designor some combination of bothare necessary for an effective global minimum corporate tax.
