Baker Files Closeout Budget
Baker has filed a $840 million request to finalize and pay out the Fiscal Year 2022 budget, funds that are still to be approved by the Legislature. The closeout budget includes an additional $200 million for the MBTA to allow it to address some of the issues in the Federal Transit Authority report released Aug. 31, as well as another $10 million for the creation of a T training academy.
Included in Bakers closeout budget is $108 million for a COVID-19 cost reserve account and enough funds to ensure that a guardian ad litem can be appointed in every juvenile court proceeding in which a child is alleged to have been abused or neglected.
The progressive caucus could meet as early as next week.

Massachusetts Supreme Court Dismisses Capital Gain Tax Of Florida Company
On May 16, 2022, Massachusetts top court rules that The Commissioner of Revenue does not have the statutory authority to tax capital gain of VAS Holdings & Investments LLC . In 2011, VASHI, an Illinois and Canada-based S corporation at the time, merged with Thing5, LLC , a Massachusetts limited liability company consequently, a Massachusetts limited liability company Cloud5 LLC was formed. Since then, VASHI has remained uninvolved in Cloud5 business activity other than holding its 50% membership interest. In 2013, VASHI sold its interest in Cloud5 which resulted in a capital gain. The Tax Board deemed the gain to be taxable in Massachusetts based on the argument that Cloud5s growth was partly a result of business activity in Massachusetts. While the Court agreed that there was an element of constitutional nexus within the Commonwealth, the Court concluded VASHI is not subject to state tax on the capital gain. Specifically, since VASHI was not engaged in any unitary business with Cloud5 and did not engage in a trade or business in Massachusetts, and as such, Massachusetts is precluded from taxing VASHI.

Income Tax Paid To Another Jurisdiction Tax Credit
If youâre a Massachusetts resident or part-year resident and you report income to another state, U.S. territory, or to a Canadian province, you may be entitled to a credit for the amount of income tax paid to the other jurisdiction.
Full-year residents may receive a credit for the entirety of their adjusted tax paid. Part-year residents will receive a credit for the lesser of the amount of taxes due to the other jurisdiction or the amount of your Massachusetts tax due on the gross income taxed in that jurisdiction.
This credit isnât refundable and it doesnât carry forward.

Massachusetts taxpayers are getting nearly $3 billion in income tax payments back, the state Executive Office for Administration and Finance has confirmed. Thanks to Chapter 62F, a 1986 voter-approved statute, tax revenue is tied to growth in wages and any excess must be returned to taxpayers. This is only the second time that the refund has been triggered.
Massachusetts Finance Secretary Michael Heffernan said taxpayers will receive a credit “in the proportion that they paid in.” Previously, the administration said the refund would be approximately 13% of their 2021 state income tax liability. That’s just an estimate, however — the actual amount won’t be finalized until after all 2021 tax returns have been filed in late October. And individual refunds could be offset by unpaid tax liabilities, child support payments and other debts.

Massachusetts Finds Subscription Fees To Software Taxable Which May Have Income Tax Ramifications
Last month, the Massachusetts Supreme Court held that the receipts from sales of subscriptions for online software products were subject to sales tax, pursuant to G. L. c. 64H, §§ 1-2 and 830 Code Mass. Regs. § 64H.1.3 . The regulation provides for a two-part test for when tax does not apply to charges for access or use of software on a remote server: here there is no charge for the use of the software and the object of the transaction is acquiring a good or service other than the use of the software, sales or use tax does not apply. The evidence indicated that the taxpayers customers entered into a transaction for access and use of the taxpayers online products, which was essentially standardized computer software. As a result, the court rejected the taxpayers assertion that the true object of what their customers were paying for was their service of providing online access. Rather, the court determined that the taxpayers customers were in fact buying software, which should be treated as the sale of tangible personal property, and thus subject to sales tax. Since the underlying transaction was determined to be taxable so was the subscription service. Additionally, the court noted that the legislature broadened what it means to transfer tangible personal by amending the rule and allowing for an apportionment of tax based upon usage in more than one state.Citrix Systems v. Refunds And Credit Of Overpayments
When you pay more taxes than the amount of taxes determined to be due an overpayment may be generated on your account. An overpayment may also be generated if you are entitled to a refundable credit that exceeds the amount of tax due. Additionally, when you file an amended return or an abatement application to reduce the amount of tax due, and you previously paid more than what is now shown as due, an overpayment may be generated.
An overpayment claimed on a return may be applied as a credit for your next years estimated tax or you may request that it be refunded to you. An overpayment may also be offset or intercepted by the Department of Revenue and applied to another liability. However, often an overpayment is refunded directly to you.
Most refunds are claimed on an original return and will be issued automatically by the Department. For e-filed returns the turnaround time is about 6 weeks but for paper returns it could take up to 10 weeks. You must claim your refund or credit within a certain time period, as further detailed below. Also, the Department of Revenue must issue refunds within a certain time period or pay interest on the amount of the refund. Stimulus Checks And Tax Rebates Are Being Sent By 17 States Through Autumn
Stimulus checks and tax rebates were a lifesaver for many suffering from job loss and inflation during the pandemic. Many states will be sending their own through the rest of autumn before 2023.
There are currently around 17 states sending payments of some sort to qualifying residents. A lot of these payments are in the form of tax rebates being paid for by a tax revenue surplus.
Each state has different criteria and amounts for what they plan to give residents. A lot of states have already sent money to residents, or are continuing to through the fall. Other states have just started.
In addition to state payments, the IRS is still finishing up sending stimulus checks to late filers.
Massachusetts Issues Guidance On New Pass
On September 30, 2021, the Massachusetts Legislature adopted an elective pass-through entity excise tax in response to the federal state and local tax deduction cap of $10,000. For tax years beginning on or after January 1, 2021, certain qualifying pass-through entities may elect to pay a new-entity level excise tax on qualified income that is taxable in Massachusetts at a 5% tax rate. Qualified members of an electing PTE are eligible for a credit equal to 90% of a members distributive share of PTE excise paid. Massachusetts issued the following guidance:
- An eligible pass-through entity is defined as an S corporation under section 1361 of the Internal Revenue Code , a partnership under section 7701 of the IRC or a limited liability company that is treated as an S corporation under these sections.
- The PTE Excise tax is not mandatory, and the related provisions only apply to a PTE if they elect to be subject to the excise. This election is made on an annual basis.
- Once an election is made for that particular tax year, it is irrevocable for that year and is binding on all qualified members of the PTE.
- Qualifying pass-through entities can make an election annually by filing Form 3, Form 355S or Form 2, and is confirmed by submitting new Form 63D-ELT. The election cannot be made on an amended form. Form 63D-ELT must be filed on or before the due date of the PTEs tax return, accounting for valid extensions. Qualified members cannot opt out of an election.

What Are The Penalties For Late Filing And Underpayment Of Taxes
If there is a failure to file a tax return by the due date, it results in a one percent per month of the unpaid tax being charged. This is up to 25 percent per Mass General Laws 33. Not paying a due tax also results in one percent of the unpaid tax up to a maximum of 25 percent according to Laws 33.
The failure to pay deficiency assessment is one percent up to 25 percent per state law 33. This penalty is combined with Massachusetts General Law 33. This combination makes it a double penalty.
Filing a fraudulent return or failing to file after a notice results in a penalty up to double the tax amount due.
How Much Will My Tax Refund Be
The money will be returned to eligible taxpayers by the state Department of Revenue in proportion to their personal income tax liability in Massachusetts incurred in the immediately preceding taxable year — Tax Year 2021. In general, the administration said eligible taxpayers will receive a credit in the form of a refund that is approximately 13% of their Massachusetts Tax Year 2021 personal income tax liability. However, that percentage is just a preliminary estimate and could still change before it is finalized in late October, once all 2021 tax returns have been filed.

What About Massachusetts Taxes If You’re A Business
A business and manufacturing corporation pays an eight percent tax rate on net income. There is also a charge of $2.60 per $1,000 of tangible property or net worth. The minimum a corporation can pay is $456 per tax year.
An S-corporation pays two percent of net income for total sales receipts of $6 million or more but less than $9 million. The minimum paid per tax year is $456. It pays $2.60 per $1,000 of tangible property or net worth.
LLCs, S- corporations and partnerships are pass-through entities. In Massachusetts, these members must file on their personal tax returns. But pass-through entities must report to the DOR how each member will comply with filing.

Massachusetts Update On Extension Of Filing Deadline
The Massachusetts Department of Revenue has announced that individual income tax returns and payments for the 2020 tax year otherwise due April 15, 2021 are now due May 17, 2021. Taxpayers that have already filed their 2020 returns without making associated payments have until May 17, 2021 to make such payments. Individual taxpayers will be eligible for an automatic extension of time to file their personal income tax returns if the amount required to be paid for an extension is paid by May 17, 2021. This extended due date does not apply to estimated tax payments. The Department of Revenue intends to issue additional guidance as needed.
