First things first: what is the federal corporate tax rate? The current corporate tax rate is 21%, thanks to the Tax Cuts and Jobs Act of 2017.
Prior to the Tax Cuts and Jobs Act, there were taxable income brackets. The maximum tax rate was 35%.

Federal Corporate Tax Rate Example
Lets say you have annual revenues of $250,000 and qualifying expenses of $55,000. You want to figure out how much you owe in federal taxes.
First, subtract your expenses from annual revenues:
Taxable Income = $250,000 $55,000
Next, multiply the federal corporate tax rate of 21% by your taxable income:
$195,000 X 0.21 = $40,950
You would owe $40,950 in federal corporate taxes.
Corporate Tax Avoidance And Corruption
Corporate tax avoidance refers to the use of legal means to reduce the income tax payable by a firm. One of the many possible ways to take advantage of this method is by claiming as many credits and deductions as possible.
An empirical study shows that state-level corruption and corporate tax avoidance in the United States are positively related. According to the average effect of an increase in the number of corporate corruption convictions, it is observed that state-level corruption reduces Generally Accepted Accounting Principles tax expense.
The main occurrence of corruption and corporate tax avoidance was in states that had the lowest level of litigation risk despite their ranking in social capital, money laundering and corporate governance. Hence, strengthening law enforcement would definitely control the level of corruption caused by tax avoidance. Corruption is distinct from earnings management predictions, disclosure of accounting restatements as proof of fraudulent accounting and tax accruals quality. Corruption metrics show that firms with their headquarters in a state with a high level of corruption are more likely to participate in tax evasion.
According to research on culture and tax evasion, corruption can be caused by increased organizational, financial and legal complexity and the same factors can influence a firm’s chance of engaging in corporate tax avoidance.
Definition Of Selected Corporate Income Tax Rate
The dataset captures standard top statutory corporate income tax rates levied on domestic businesses. This means:
- The dataset does not reflect special tax regimes, including but not limited to patent boxes, offshore regimes, or special rates for specific industries.
- A number of countries levy lower rates for businesses below a certain revenue threshold. The dataset does not capture these lower rates.
- A few countries levy gross revenue taxes on businesses instead of corporate income taxes. Since the tax rates of a corporate income tax and a gross revenue tax are not comparable, these countries are excluded from the dataset.
- Some countries have a separate tax rate for nonresident companies. This dataset does not consider nonresident tax rates that differ from the general corporate rate.

State And Local Income Taxes
Nearly all of the states and some localities impose a tax on corporation income. The rules for determining this tax vary widely from state to state. Many of the states compute taxable income with reference to federal taxable income, with specific modifications. The states do not allow a tax deduction for income taxes, whether federal or state. Further, most states deny tax exemption for interest income that is tax exempt at the federal level. CIT rates range from 1% to 12%, varying for every state. The most common federal taxable income is based on apportionment formulae. State and municipal taxes are deductible expenses for federal income tax purposes.
Most states tax domestic and foreign corporations on taxable income derived from business activities apportioned to the state on a formulary basis. Many states apply a “throw back” concept to tax domestic corporations on income not taxed by other states. Tax treaties do not apply to state taxes.
Corporation Tax On Chargeable Gains

Consequences Of A Minimum Book Tax On Financial Accounting And The Tax Code
Imposing a minimum tax based on corporate financial income would, to some extent, effectively hand over the determination of this part of the tax base to FASB, the nonprofit body that is certified by the Securities and Exchange Commission to make decisions and adjustments to GAAP rules.
Such a possibility is concerning, because it deprives elected representatives in Congress a degree of control over the tax base. It would insert FASB into tax disputes normally resolved by the democratic process and elected representatives, IRS guidance, and tax courts. It would also introduce additional concerns and responsibilities for FASB, which is currently not well equipped to resolve complex business tax issues.
Policymakers could choose to deviate from FASBs decisions for book income, but it would quickly increase the risk of creating an entirely new definition of income that conforms with neither tax nor book income. Having a third definition of income would increase compliance costs for firms while reducing the effectiveness of the book tax at closing book-tax income gaps.
Tentative evidence suggests that the reporting of financial income would be sensitive to tax, especially in the case of a direct tax on book income and to a lesser degree in the case of a minimum book tax. One measurement of how financial incomes responds to taxation suggests a large responsiveness of financial statement income.
Economic And Revenue Effects Of A Minimum Tax On Corporate Book Income
Using the Tax Foundation General Equilibrium Model, and based on the Biden campaigns descriptions, we estimated that Bidens proposed 15 percent minimum book tax would raise about $202.7 billion in additional revenue from 2021 to 2030, when combined with Bidens other tax proposals. This compares to the Biden campaigns estimate that the minimum book tax would raise about $400 billion over 10 years.
The interaction between a higher corporate income tax rate and Bidens proposed changes to the tax treatment of foreign income may undercut the minimum taxs ability to raise revenue particularly on the foreign income of U.S. multinationals. To the extent Bidens proposal does not provide offsets for domestic investment incentives, such as accelerated depreciation and the R& D credit, the minimum tax would likely fall most heavily on the U.S. domestic manufacturing and information technology sectors.
We estimate that Bidens minimum tax would reduce long-run economic output by about 0.21 percent in combination with Bidens other tax proposals. The impact of the minimum tax on output depends on its structure and treatment of investment incentives specifically. For example, if the minimum tax does not provide a credit for tax provisions like accelerated depreciation, the tax would be more harmful to investment and economic output.

Us Effective Corporate Tax Rates Are Not A Burden
The top statutory tax rate of 35% in the U.S. is somewhat higher than that of 30 other OECD countries, but the average effective tax rate the actual rate paid after deductions and credits is slightly lower than our competitors, according to the Congressional Research Service .
Several studies have found that U.S. corporations pay a similar or a lower effective tax rate the rate actually paid than corporations in other countries. For example:
- Our average effective tax rate is 27.1% compared with 27.7% for the other 30 OECD countries, according to CRS.
- Profitable corporations paid U.S. income taxes amounting to just 12.6% of worldwide income in 2010, according to the Government Accountability Office.
- Citizens for Tax Justices survey of 288 corporations, which included most of the Fortune 500 corporations that were profitable each year from 2008 through 2012, found that they paid an average effective federal tax rate of just 19.4% over that period.
- Of 125 corporations in that study that had significant foreign profits, 82 paid a higher effective rate to foreign governments than they paid to the U.S.

How Do Corporation Taxes Work
A corporation, or C Corp, is a type of business structure where owners enjoy limited liability protection. Corporations are separate legal entities, meaning they are separate from their owners. Owners are not responsible for their corporations actions and debts .
But because corporations are separate legal entities, they are subject to double taxation. The company itself pays taxes on its earnings and the owner also pays taxes. In other business structures , taxes pass through to the owner so they only pay taxes on earnings once.

Corporate Tax In The United States
Corporate tax is imposed in the United States at the federal, most state, and some local levels on the income of entities treated for tax purposes as corporations. Since January 1, 2018, the nominal federal corporate tax rate in the United States of America is a flat 21% due to the passage of the Tax Cuts and Jobs Act of 2017. State and local taxes and rules vary by jurisdiction, though many are based on federal concepts and definitions. Taxable income may differ from book income both as to timing of income and tax deductions and as to what is taxable. The corporate Alternative Minimum Tax was also eliminated by the 2017 reform, but some states have alternative taxes. Like individuals, corporations must file tax returns every year. They must make quarterly estimated tax payments. Groups of corporations controlled by the same owners may file a consolidated return.
Some corporate transactions are not taxable. These include most formations and some types of mergers, acquisitions, and liquidations. Shareholders of a corporation are taxed on dividends distributed by the corporation. Corporations may be subject to foreign income taxes, and may be granted a foreign tax credit for such taxes. Shareholders of most corporations are not taxed directly on corporate income, but must pay tax on dividends paid by the corporation. However, shareholders of S corporations and mutual funds are taxed currently on corporate income, and do not pay tax on dividends.

The Corporate Alternative Minimum Tax
This law eliminates the corporate alternative minimum tax . Before 2018, the corporate AMT had a 20% tax rate that kicked in if tax credits pushed a firm’s effective tax rate below that percentage. The law repealed the option for companies to deduct certain research-and-development expenses in the year incurred, beginning in 2022. They must capitalize and amortize those expenses.
Some Corporations Pay Nothing In Taxes
- General Electric, Boeing, Priceline.com, Verizon and 22 other profitable Fortune 500 firms paid no federal income taxes from 2008 through 2012, according to Citizens for Tax Justice.
- 111 profitable Fortune 500 firms paid zero federal taxes in at least one of those five years.
- General Electric, one of the most notorious corporate tax dodgers, got $3.1 billion in refunds on $27.5 billion in profits from 2008 to 2012. The company paid less in federal income taxes in five years than a single American family pays in one year.

The Statutory Corporate Income Tax And American Competitiveness
The TCJA brought the U.S. statutory corporate tax rate down from a federal-state combined rate of 38.9 percent in 2017then the highest in the OECDto 25.8 percent in 2020, slightly above the current OECD average of 23.4 percent.
Prior to the TCJA, the high U.S. corporate tax rate reduced U.S. competitiveness and encouraged corporations to shift profits abroad and in some cases to invert, i.e., move headquarters to a foreign jurisdiction to avoid U.S. tax liability. Inversions were due to the high tax rate and the worldwide system of corporate taxation, which required corporations to pay U.S. tax on worldwide profits after receiving a credit for foreign taxes paid. By lowering the corporate tax rate and moving closer to a territorial tax system, the TCJA reduced the incentive for U.S. corporations to invert and engage in other methods of profit shifting.
The high pre-TCJA corporate tax rate, combined with additional capital gains and dividends taxes on distributed corporate income, also encouraged C corporations to reorganize into pass-through entities, which are subject to only one layer of tax at the individual level. For example, the number of C corporations decreased from a high of 2.6 million in 1986 to 1.6 million in 2017, while the number of S corporations increased from about 800,000 to 4.7 million over the same period .
Federal Corporate Income Tax Rates
The federal corporate income tax was fist implemented in 1909, when the uniform rate was 1% for all business income above $5,000. Since then the rate peaked at 52.8% in 1969. On Jan. 1, 2018, the corporate tax rate was changed from a tiered structure that staggered corporate tax rates based on company income to a flat rate of 21% for all companies.

Who Pays Corporatie Income Tax
Public and private companies usually have to pay corporate income tax on their profits. In certain circumstances, foundations and associations must also file corporate income tax returns.
Some legal entities, such as fiscal investment institutions, do not pay corporate income tax. Some legal entities that collectively invest, may also be exempt from corporate income tax.
Natural persons pay tax on their profits through their personal income tax returns.
Corporate Minimum Book Taxation
During the 2020 presidential primaries, two candidates proposed taxes on the financial book income of corporations in addition to the standard corporate income tax.
Sen. Elizabeth Warren proposed a Real Corporate Profits Tax to be levied at 7 percent of a corporations profits as reported on financial statements after the first $100 million in profits. It would be assessed in addition to the standard corporate income tax.
President Biden proposed a minimum tax of 15 percent on the financial income of corporations reporting more than $100 million in book income. Unlike Warrens proposal, Bidens proposal would operate as a minimum tax that would be applied to large corporations if their effective tax rate falls below 15 percent on income as reported on financial statements.
A minimum tax on book income would introduce significant complexity into the corporate tax code while outsourcing key aspects of the corporate income tax to unelected decision-makers at the Financial Accounting Standards Board , who establish the standards for corporate book income. It may also undercut other proposed changes to the tax code, such as Bidens proposed tax credit for onshoring of American supply chains.
