Virginia’s minimum wage is greater than the federal standard of $7.25 per hour. All firms in Virginia need to pay their employees at least $9.50 per hour. Companies must pay at least $2.13 per hour to tipped workers if their tips bring them to the hourly minimum wage. Otherwise, the corporation must make up the difference.

Electronic filing requirement

You must submit all of your income tax payments electronically if:

  • Any installment payment of estimated tax exceeds $1,500 or
  • Any payment made for an extension of time to file exceeds $1,500 or
  • The total income tax liability for the year exceeds $6,000

If any of the thresholds above apply to you, all future income tax payments must be made electronically.This includes all payments for estimated taxes, extensions of time to file, and any other amounts due when a return is filed.

Virginia State Statute Of Collections For Taxes

The Department of Taxations ability to collect back taxes is limited somewhat by the Statute of Limitations. The Statute of Limitations is a period prescribed by law for a specific type of legal action.

According to Virginia Code § 58.1-104 and the Virginia Tax Administrative Code, the Department must assess past due taxes within 36 months from the date the taxpayer initially owed the tax. However, if the taxpayer fails to file his or her return, then the Statute of Limitations does not apply. In other words, the Department can collect taxes at any time in the future.

In terms of the time limit for the state to collect taxes assessed and due, Virginia generally has 20 years to obtain the state taxes after the date of assessment. The taxpayer should understand when the Statute of Limitations comes into effect. It is always essential to determine when the department assessed taxes and to timely raise the defense if applicable.

What Are The Child Labor Laws In Virginia

Workers aged 16 and up are not subject to any limitations. However, 14 and 15 years old children must get an employment certificate under Virginia law. Household Employer Withholding Tax

Employers of certain household employees have the option of reporting and paying the Virginia income tax withheld from those employees on an annual basis. For the employer to qualify, the employment must consist exclusively of domestic service in the private home of the employer, as defined in the Federal Employment Tax Regulations.

The annual filing provision is a filing option for qualified employers. It does not establish a new requirement for withholding. Unlike the federal “nanny tax,” the Virginia household employer’s withholding tax is filed on a separate return, and is not included in the employer’s personal income tax filing. If you choose to register for this annual filing option, you will be required to file Form VA-6H, the Virginia Household Employer’s Annual Summary of Income Tax Withheld, by Jan. 31 each year to report and pay the Virginia income tax withheld for the preceding calendar year. You must file Form VA-6H online, either through your online services account or through eForms.
